1. Acceptance
These Terms of Service ("Terms") govern your access to and use of Songly (the "Service"), available at https://songly.fun. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Who provides the Service
Songly is operated by Johann Briem, an individual based in Iceland ("we", "us", "our"). Contact: johannbriem@gmail.com.
3. Eligibility
You must be at least 13 years old (or 16 if you reside in the European Economic Area) to use the Service. By using the Service, you confirm that you meet this requirement. If you connect Spotify, you must additionally meet the eligibility requirements of Spotify's Terms of Service.
4. Description of the Service
Songly is a free, music-based party game in which a host plays short audio previews and players guess metadata about each song (year, artist, decade, etc.). Audio previews are sourced from the public Apple iTunes Search API. Optional Spotify integration allows signed-in users to play games using their own Spotify playlists.
The Service is provided as a personal, non-commercial entertainment product. We may add, change, suspend, or remove features at any time without prior notice. The Service is provided free of charge.
5. Accounts
You may use most of the Service without an account. If you choose to create an account:
- You are responsible for the accuracy of the information you provide
- You are responsible for keeping access to your sign-in email secure
- You may not share your account with others or impersonate another person
- You may delete your account at any time by contacting us
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Acceptable use
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the Service, other users' accounts, or our infrastructure
- Reverse-engineer, decompile, or disassemble the Service except where permitted by law
- Use the Service to transmit any virus, worm, or other malicious code
- Spam, abuse, harass, or threaten other players
- Scrape, copy, redistribute, or commercially exploit Spotify or Apple content beyond what is permitted by their respective terms
- Resell, sublicense, or commercially exploit the Service or any content accessed through it
- Bypass any rate limits, access controls, or technical restrictions
- Use the Service in any way that infringes the intellectual property rights of others
7. Third-party services
The Service relies on third-party APIs and platforms. You acknowledge and agree that:
- Spotify. Optional integration for personal playlists. You agree to comply with Spotify's Terms of Service. Songly is not affiliated with, endorsed by, or sponsored by Spotify. Spotify is a registered trademark of Spotify AB.
- Apple iTunes Search API. Used to fetch 30-second song previews. You agree to comply with Apple's iTunes terms.
- Supabase. Account and event storage.
- Vercel. Hosting.
We are not responsible for the availability, content, or practices of any third-party service. If a third-party service is unavailable, changes its terms, or revokes our access, the Service may stop working in whole or in part.
8. Intellectual property
8.1 Our content
The Songly name, logo, design, and original code are owned by Johann Briem. You may not copy, modify, or redistribute them without prior written permission.
8.2 Music content
All music played through the Service belongs to its respective rights holders. The Service does not host or distribute music files; it streams short previews directly from Apple iTunes (or, where applicable, exposes a user's Spotify integration). We do not claim ownership over any music, artist names, album titles, or related metadata.
8.3 Your content
You retain ownership of any content you provide (e.g., a custom display name). By providing content, you grant us a worldwide, non-exclusive, royalty-free license to use it solely to operate and improve the Service.

You agree to defend, indemnify, and hold harmless Johann Briem and any contributors to Songly from any claim, demand, loss, or damage (including reasonable attorneys' fees) arising out of: your use of the Service; your violation of these Terms; or your violation of any third-party rights, including any rights under Spotify's or Apple's terms.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including but not limited to if you violate these Terms. You may stop using the Service and delete your account at any time.
Sections that by their nature should survive termination — including 7 (Third-party services), 8 (Intellectual property), 9 (Disclaimer), 10 (Limitation of liability), 11 (Indemnification), and 13 (Governing law) — will continue to apply after termination.
13. Governing law and disputes
These Terms are governed by the laws of Iceland, without regard to its conflict-of-laws rules. Any disputes arising out of or relating to these Terms or the Service will be resolved exclusively in the courts of Reykjavík, Iceland, and you consent to the personal jurisdiction of those courts. Nothing in this section deprives you of any mandatory consumer-protection rights granted by the laws of your country of residence.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent change. If we make material changes, we will provide additional notice (e.g., a banner on the Service or, for account holders, an email). Continued use of the Service after a change constitutes acceptance of the updated Terms.
15. Severability and entire agreement
If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
